The roads proposed to be closed form part of a light industrial estate land division dating from the 1980s. In over 40 years, the light industrial estate was never developed.

The landowner is looking to undertake a residential development on the land, which requires the unmade roads that formed part of the previous land division plan, to be closed so that a new land division can progress.

To close a road, the first step is to commence a road process order under the Roads (Opening and Closing) Act 1991 for the purpose of closure and sale of unmade road reserves within the Whittam Transport Depot land at Strathalbyn, to consolidate their land holdings to facilitate further development opportunities.

The proposal is to close a portion of 10,360 m² of surveyed unmade roads located within the Whittam’s Transport Depot, consistent with the proposed preliminary plan provided within this consultation documentation.

As part of the road process, community engagement and notification is required in accordance with the specific requirements of the Roads (Opening and Closing) Act 1991 and the Roads (Opening and Closing) Regulations 2021 and forms the intent of this consultation.

Important information:

  • As part of the legislative requirements, Regulation 7 of the Roads (Opening and Closing) Regulations 2021 directs that an objection to a proposed road process must:
    • set out the full name and address of the person making the objection,
    • state with reasonable particularity the reasons for the objection, and
    • state whether the objector wishes to make a submission to the meeting of Council at which objections to the proposal will be considered.
  • We are only seeking responses on the proposal to close the unmade roads, not on the zoning of the adjoining land and not on the current development application before the Fleurieu Regional Assessment Panel.

A response that does not include all of this information will not be regarded as a formal objection.
