Update March 2025

Council completed the revocation of the community land classification over Lot 4 Landseer Road Milang, with the intention to dispose of the land to the adjacent landowner by merger.

Council resolved to:

  • Revoke the classification as community land of Lot 4 Landseer Road Milang.
  • Notify the Registrar-General of the revocation of community land classification over the subject land.
  • Grant consent to dispose of the land at Lot 4 Landseer Road by sale to the adjacent landowner by merger, once the Registrar-General has removed the 'Reserve' notation from the title.
  • Approve the disposal value of Lot 4 Landseer Road to be in accordance with the higher of the two (2) independent market valuations required to be obtained for the land, in accordance with Council's Acquisition and Disposal of Land Policy, and grant consent for the Mayor and Chief Executive Officer to sign and seal all documentation necessary to facilitate the sale as required.
  • Explore the capacity to redirect revenue generated from this sale, towards local land conservation practices in Milang as part of the 2025/26 budget considerations.

Update October 2024 

Council received the community engagement submissions regarding a Strategic Land Program proposal to dispose, by amalgamation, a Council-owned community land parcel at Lot 4 Landseer Road at Milang. 

Council Members affirmed that they were satisfied that Council had complied with due process, they consented to a Revocation of Community Land proposal being sent to the Planning Minister, and to receive a further Report following the decision of the Minister.

Council’s Strategic Land Program is progressing a request from the landowner adjacent Lot 4 Landseer Road Milang, to purchase the land parcel by amalgamation into their existing property.

In order to consider the proposal, the community land classification over the land is required to be revoked. In order to consider the revocation of the community land classification, the Council seeks the community’s views on the proposal.

The reserve the subject of this community engagement as highlighted below is contained within Certificate of Title Volume 5892 Folio 456 and commonly described as Lot 4 Landseer Road.

For context, it is located as identified in red below within the vicinity of Milang.

At first sight, the subject land may appear to be related to the adjoining former Strathalbyn to Milang rail corridor. The rail corridor contains important biodiversity values. Lot 4 Landseer Road was never part of the rail corridor and was farming land until a land division resulted in an open space requirement. As is sometimes the case, Council inherited a ‘reserve’.

At the 17 June 2024 Council Meeting, the Council supported proceeding to community engagement on a proposal to dispose of this land parcel by sale to the adjacent landowner.

The full proposal for the revocation of the community land classification and the merits for progressing this request are provided in detail in the Information Pack attached.

Community engagement on progressing this proposal will inform Council and the Minister responsible for making the decision as whether to revoke the classification or otherwise.
