What is the Clayton Bay Boat Club?
Since 1990, the Clayton Bay Boat Club has held 21-year community lease agreements with Council for the provision of ‘recreational boating club, marina and boat storage purposes’ at Clayton Bay.
Where is it located?
Portion of Island View Drive Clayton Bay South Australia. The land is a combination of Council owned community land and road reserve located directly on the waterfront. The Club are responsible for the jetty and boardwalks located adjacent their club grounds by annual licence agreement directly with the Department for Environment and Water (DEW).
As part of their existing lease conditions, the Club has permission to utilise the road section within the club grounds, which meanders along the river bank between the club house and the river bank. Public access is retained along this foreshore walkway, providing pedestrian linkages along the entire riverbank frontage for visitors and residents to Clayton Bay to enjoy.
This combination, of utilising both land and road under a Tenure Agreement, is consistent with other Tenure Agreements across the Alexandrina Council region.
In addition, the Club are also provided with a permit to utilise a portion of the public reserve adjacent to the club grounds on the southern side, for special event overflow parking each year (approximately 8-10 events) by annual non-exclusive permit agreement. The Committees proposal is to expand their existing lease area into this public reserve on a permanent basis. If a new lease over an expanded lease area was granted, the annual permit would be cancelled, and all parking would be required to be contained within the new lease area.
Proposal – expanded lease area
The proposed area of extension is 50m x 72m, however the Clayton Bay Boat Club have indicated that they would appreciate any additional area to assist in meeting club member demand. The purpose of the extended area is to accommodate approximately 20 hard stand sites for storage purposes, provide an area for sail craft bays and additional vehicle / trailer parking spaces during events. The proposal includes a commitment from the club to improve fencing and revegetate unusable hardstand areas.
Should the additional lease area be supported following public consultation, it would be dealt with as a new lease agreement and road rental permit with the Clayton Bay Boat Club.
At the 20 September 2021 Council meeting, Council endorsed proceeding to public consultation to gauge the community’s appetite to enter a new 20 year lease with the Clayton Bay Boat Club commencing as soon as practical (not on expiry of current lease) inclusive of the proposal to expand the Clubs area into a portion of the adjacent reserve and road reserve.
Fees
The current annual rental fee is approx. $2,700 (ex GST) as was set when the lease commenced in 2012, with annual increase by CPI. Since the introduction of the Lease and Licence Policy, the fee for any new Minor Commercial Community Agreement would be $500 (ex GST) per annum.
Any new lease fee would be proposed at $500 (ex GST) which would capture the existing lease area and the proposed expansion area.
What does the Clayton Bay Foreshore Master Plan say?
The Clayton Bay Foreshore Master Plan was adopted at the 15 June 2015 Council Meeting (ACM15211). The objective of the Master Plan project aim was:
“to balance demands for recreation and nature, beauty and function, heritage and progress; creating a foreshore that continues to attract people while protecting and enhancing the natural and cultural landscapes of the area”.
The Clayton Bay Foreshore Master Plan recognised the existing occupancy of the Clayton Bay Boat Club in Clayton Bay and referenced the Boat Club within the plan. The precinct plan actions of the Clayton Bay Foreshore Master Plan included;
A new lease would provide opportunity to strategically align the Boat Club’s conditions to the Clayton Bay Foreshore Master Plan.
What did the Clayton Bay Village Conversations say?
The Clayton Bay Village Conversations were held in May 2021. The Community's participation in the Conversations was strong, with over 100 attendees across the program.
