Council sought feedback on a proposal to close and dispose of portions of unmade roads Chance Street and Browne Street in Currency Creek.

The owner of land adjoining the southern ends of the unmade Chance and Browne streets at Currency Creek, approached Council seeking to acquire those portions of the roads to facilitate a development application to build four (4) accommodation cabins with accompanying orchard / horticultural area.

The reason for the request was to consolidate the owners landholding into a more practical undivided envelope for development purposes. The closure of the southern end of Chance Street is essential to enable irrigated disposal of wastewater entirely within their own property, which would be required in order to gain development approval.

The closure of public roads is dealt with under the Roads (Opening and Closing) Act 1991 and Roads (Opening and Closing) Regulations 2021.

The inclusion of public consultation, forms one of numerous process components for obtaining consent to close and dispose of a road, to ensure the public has adequate information and opportunity to provide comment, support or objections to the proposal.

Things we asked the community to consider:
  • The two portions of roads are unmade, meaning they have not been constructed or formally developed.
  • We were seeking feedback on the road closure not the development application.
