Project Update

Following Community Consultation, all submissions were brought back to the 21 August Council Meeting where Council endorsed the new 2023-2028 Community Land Management Plan and revoked the previous Community Land Management Plan.

Community Land Management Plan 2023-2028 (Draft 2)

A Community Land Management Plan is a document that guides the management of each parcel of community land based on its category.

Following an extensive review during 2022, a draft 2023-2027 Community Land Management Plan (Draft 1) was prepared to replace Council’s existing outdated Community Land Management Plan. Public Consultation on this Plan (Draft 1) was held between 22 December 2022 and 27 January 2023.

Following the feedback received and further legal advice the Plan has been redesigned to reflect this.

What is Community Land?

All local Government Land (except roads) that is owned by Council or under Council’s care, control and management (for example Crown Land) since the commencement of the Local Government Act 1999 (Act) is classified as community land, unless the Council resolved to exclude the land from classification as community land within three (3) years after the commencement date of the Act and, there were no provisions of a reservation, dedication, trust or other instrument that would prevent or restrict the community land status.

The importance of having land classified as Community Land, is the inclusion of robust community and interest group engagement and Ministerial referrals that must be undertaken as part of the decision-making process when determining the use of community land. Essentially, the community land classification protects the community's interests in the land.

What has changed in the Plan between Draft 1 and Draft 2?

As an overview, the main amendments to Draft 2 of the Plan are:

Removal of the Community Land Register as an Annexure to the Plan

The Register is a separate document that can be found on Council’s website. This is an outcome of legal advice
Term of the Plan updated to 2023-2028
Recognises that the Plan is proposed to be endorsed in late 2023 (rather than at the commencement of the year)
Each land category now contains a schedule of the specific Title references (CT/CR) within each category, with the Community Land Management Plan

Following legal advice, this inclusion allows the Register to be maintained separately to the Plan as a live document.

It permits the Register to be kept current and accurate without compromising the validity of the Plan

“Multi-Use Land” has been Annexed to the Plan

“Multi Use Land” recognises those parcels of Community Land that contain a wide range of infrastructure and/or activities.

Due to multiple uses across one land parcel, the land does not fit exclusively into one management category.

The “Multi-Use” inclusion ensure there is no ambiguity in the assessment of land parcel use, supported by aerial imagery outlining which part of the land is subject to which category within the Plan

A reference to Multi Use Land has been included within each category
This will ensure that users of the Plan can clearly view multi-use imagery and determine which sections of the land form which category of the Plan.
Change from “caravan Parks and Camping Grounds” to “Holiday Parks and Camping Grounds”
Reflects the current trend to recognise Parks as “Holiday” destinations rather than parks for caravans only (eg. cabins, ‘glamping tents’ etc.)
Removal of “Facilities” after the category Sporting and Recreation
Recognition that sporting and recreation places are not necessarily ‘formed facilities/assets’
Updated references from “Public Consultation” to “Community Engagement”
To reflect current council community engagement practises and documentation
Minor administrative changes

Minor wording changes across the Plan for clarification of Objectives, Performance Measures and Performance Targets.
