Council received the community engagement submissions on a proposal to close a portion of unmade road reserve located adjacent to Lot 7 Braeside Road Mount Observation for the purpose of sale to the adjoining landowner and gave the green light to progress.

In accordance with section 10 of the Roads (Opening and Closing) Act 1991, Alexandrina Council proposes to make a Road Process Order to close and sell a portion of an unnamed road adjacent to the land described as Lot 7 Braeside Road Mount Observation.

Alexandrina Council is seeking submission on a proposal to close and merge a portion of unmade road with Lot 7 Braeside Road Mount Observation. The owner of Lot 7 Braeside Road approached Council with a proposal to purchase and merge with his land that portion of an unnamed and unmade landlocked road that intrudes into the property of the owner and does not connect with any other public road.

What is the road there for – current use?

The road was surveyed many decades ago, but has never been developed as a usable road. In fact, this road is landlocked and does not connect with any other public road. The steepness of the terrain would prevent a trafficable road from being constructed on the alignment of the road reserve.

Where is it located?

The road is located at Mount Observation, between Bull Creek Road and Braeside Road. The relevant portion of the road ends in the middle of a privately owned parcel of land.

Council Proposal 

It is intended to close the road and merge it with the surrounding land parcel. A right of way is included at the southern end of the road to be closed to provide continuing legal access to those landowners who have a requirement for it.

The proposal for closure and merger is clearly identified on the preliminary plan.

Community benefit

The sale of the land will be at market value as determined by a professional valuer, providing a return to Council for the benefit of the community. Additionally, it disposes of a section of legal road that cannot be accessed by the community and provides no benefits.

Any person is entitled to object to the proposed road closure via a written submission to Council. To be a valid objection, it must comply with Regulation 7 of the Roads (Opening and Closing) Regulations 2021. An objection must be in writing, set out the full name and address of the person making the objection, must state the reasons for the objection and state whether the objector wishes to make submissions at a meeting of Alexandrina Council at which the proposed road closure will be considered. For the purpose of the submissions, an email, or submission via MySay or a hand written letter to Council are both legal forms of lodging a submission by the due date.
